Contest Rules
1. CONTEST PERIOD
The “Golf Fore the Cure Muskoka” Contest (the “Contest”) is administered by the Royal Canadian Golf Association, doing business as and hereinafter, “Golf Canada” (or the “Administrator”) and will take place in Canada from May 1, 2017, at 12:00 a.m. (ET) to October 31, 2017, at 11:59 p.m. (EST) (the “Contest Period”).
2. ELIGIBILITY
The Contest is open to all individuals (“Participants”) who:
  1. reside in Canada; and
  2. have reached the age of majority in their province of residence as of the date of entering the Contest; and
  3. Either organized a 2017 Golf Fore the Cure event that was officially registered with Golf Canada during the 2017 season, or participated in an official Golf Fore the Cure tournament hosted in their local community during the 2017 season; and
  4. Is not an employee (or a person with whom an employee is domiciled) of the Administrator.
3. METHODS OF ENTRY
3.1. To enter the Contest, Participants must fill out the entry form located online at golfforethecure.ca. Participants are granted one entry into the Contest
3.2. A Site Coordinator of a Golf Fore the Cure event may also submit the name, email and phone number of each participant of their event via the ‘Wrap Up Package’ found in the coordinator’s event kit. These individuals become automatically registered as Participants upon receipt of the Site Coordinators submission and are granted one Entry into the Contest.
3.3. No purchase is required in order to enter the Contest.
3.4 There is a limit of one (1) Entry per person, regardless of the method of Entry.
4. PRIZE
4.1. ONE (1) NATIONAL PRIZE: A trip for two (2) to Muskoka, Ontario. Trip includes roundtrip travel for two (2) Muskoka ); two (2) nights hotel accommodations; and a round of golf for two (2).
Method of travel, hotel and golf course is to be determined by the Administrator in its sole discretion, with reasonable consideration to the location of the winner’s home address and in consideration of preferred suppliers/partners of Golf Canada.
5. PRIZE RESTRICTIONS
Winner must complete the trip by September 30, 2018, or prize will be forfeited. Trip must be booked at least 14 days prior to departure. Trip subject to availability and blackout dates; Peak dates such as Canadian statutory holidays, long weekends and airline blackout periods are not available, including without limitation, Christmas break. Travel for winner and guest must be roundtrip. Administrator will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Contest, and those set forth by Administrator’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Winner must have reached the age of majority in their province of residence as of the date of entering the Contest. Unless a child of the winner, travel companions must have reached the age of majority in their province of residence as of the date of departure and must travel on same itinerary and at the same time as the winner. Travel companions must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. Administrator will not replace any lost, mutilated, or stolen tickets, passes, travel vouchers or certificates. By accepting passes, winner agrees to abide by any terms, conditions and restrictions provided by each pass.
Approximate Retail Value: $2,000. Actual value may vary based on airfare fluctuations and distance between departure and destination. Odds of winning the prize depend on the number of eligible entries received during the Promotion Period.
6. DRAW
On November 1st, 2017, at 10:00 a.m. (ET) in Oakville in the province of Ontario, at the offices of the Administrator. The Administrator will randomly draw one (1) entry from all eligible entries received during the Contest Period. No independent judging organization will be involved in the draw.
7. AWARDING OF PRIZE
7.1. To be declared a winner, a selected entrant must, in addition to meeting the Contest Eligibility criteria and otherwise complying with the Contest Rules, first:
  1. Be reached by email or phone by the Administrator or its representatives within three (3) days immediately following the selection of the Entry;
  2. In order to win the National Prize, the entrant must first correctly answer unaided, a time-limited mathematical skill-testing question to be administered by telephone at a prearranged, mutually convenient time;
  3. Sign and have witnessed the declaration and release documentation and return it to the address indicated in the documentation within three (3) days following its delivery by the Administrator or its representatives.
7.2. Disqualification: If any one of the conditions mentioned above is not met, the selected entrant will be disqualified and shall not be entitled to receive any prize, and the Administrator reserves the right, in its sole and absolute discretion, to select at random another eligible entrant as a potential prize winner.
7.3. Delivery of National Prize: Following receipt of the selected entrant’s signed declaration and release documentation, the Administrator or its representatives will send to the winner an email informing him or her of the method by which he or she may take possession of the prize. Winner must declare departure date by December 31, 2017.
7.4. Province of Québec (exclusive): Any litigation respecting the conduct or organization of the Contest may be submitted to the Régie des alcools (the “Régie”), des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie.
8. GENERAL TERMS AND CONDITIONS
8.1. Verification of Entries: The validity of any Contest Entry is subject to verification by the Administrator. Any illegible, incomplete or fraudulent entries will be disqualified. Any entrant or other individual who enters or attempts to enter the Contest in a manner that is contrary to these Contest Rules or that is otherwise disruptive to the proper operation of the Contest or by its nature is unjust to other entrants or potential entrants will be disqualified. All decisions made by the Administrator or its representatives, including without limitation those concerning the eligibility or disqualification of entrants, are final and binding without right of appeal. All entries become the property of the Administrator and none will be returned.
8.2. Acceptance of Prizes: All prizes must be accepted as described in these Contest Rules and cannot be returned, transferred to another individual, substituted for another prize or exchanged in whole or in part for money.
8.3. Substitution of Prizes: Prize is non-transferable and no substitution will be made except as provided herein at the Administrator’s sole discretion. The Administrator reserves the right, in its sole and absolute discretion, to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.
8.4. Number of Prizes/Winners: By entering the Contest, each entrant acknowledges that the Administrator shall not be required under any circumstances to award more prizes than the number of available prizes, as set out in these Contest Rules. In the event that, for any reason whatsoever (including, without limitation, as a result of an error, malfunction or defect in the design, advertising, management, implementation or administration of the Contest, whether mechanical, electronic, human or otherwise) the number of declared winners or the number of prizes claimed by entrants is greater than the number of prizes available, the Administrator reserves the right, in its sole and absolute discretion, to end the Contest in whole or in part, without notice and to award the correct number of prizes among the correct number of winners, selected in accordance with these Contest Rules from among those eligible entries validly submitted prior to the termination of the Contest.
8.5. Other Changes to Contest Rules: Without limiting the provisions of Rule 8.3 above, the Administrator reserves the right, in its sole and absolute discretion, to modify, cancel, terminate or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including, without limitation, any virus, computer bug or unauthorized human intervention or any other cause that is beyond the control of the Administrator, that could corrupt or affect the administration, security, impartiality or normal course of the Contest.
8.6. Release and Exclusion of Liability:
  1. By the Entrants: By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Administrator, the Scandinave Spa, the partners selected to supply associated prize benefits (travel, accommodations and golf facility), Subaru, TaylorMade (the “Contest Group”) and their shareholders from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Contest Rules and acceptance and use of the prize; and (ii) if selected as a potential winner, to sign the declaration and release documentation in this regard before receiving his/her prize. The Contest Group and their shareholders will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the Contest website, if applicable, during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting death, injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Administrator reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
  2. By the Winner’s Guest: The winner’s guest, as the case may be, will be required to sign documentation stating that he/she releases the Contest Group and their shareholders from any and all liability of any kind arising out of his/her participation in, and use of, a prize, and authorizes the Administrator and its advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use his or her name, photograph, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration.
8.7. Name/Image of Winners: By entering the Contest, each winner authorizes the Administrator and its advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use his or her name, photograph, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration.
8.8. Participants consent to their email address being used for future communication of products and services of Subaru (Presenting Partner of Golf for the Cure) and Golf Canada.
8.9. Personal Information: Notwithstanding the permission granted in 8.8, Unless the entrant has otherwise authorized the Administrator or another entity related to the Contest to contact him or her, the personal information gathered about entrants in connection with this Contest will be used solely for the administration of the Contest and reasons related to the Golf Fore the Cure program and its partners.
8.10. Identity of the Entrant: For the purposes of these Contest Rules, the entrant is the person who is the holder of the email account submitted in the entry form. It is to this individual that the prize will be awarded if selected and declared as the winner.
